Welcome to ClipBust! This Terms of Use agreement ("Agreement") is a legal contract between you ("you" or "User") and ClipBust Inc. ("ClipBust," "we," "us," or "our") governing your access to and use of the ClipBust website, services, applications, and products (collectively, the "Service"). By accessing, registering for, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by this Agreement and our Privacy Policy ([https://www.clipbust.com/page?t=page-privacy), which is incorporated by reference. If you do not agree to these terms, you must not access or use the Service.

1. Your ClipBust Account

Eligibility: You must be at least 13 years of age to use the Service. If you are under the age of majority in your jurisdiction (typically 18), you represent that you have your parent or guardian's permission to use the Service and that they have read and agreed to this Agreement on your behalf. Account Creation: To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. Account Security: You are solely responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify ClipBust immediately of any unauthorized use of your account.

2. User-Generated Content

Definition: "Content" includes any video, audio, text, images, comments, and other materials uploaded, posted, or displayed on the Service by users. Your Rights: You retain all ownership rights to the Content you create and upload to ClipBust. License to ClipBust: By uploading Content to the Service, you grant ClipBust a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, modify, create derivative works (such as transcoding for playback), communicate, publish, publicly perform, and display your Content for the purpose of operating, developing, providing, promoting, and improving the Service. This license continues even if you stop using our Service (for example, for archival purposes or if your content was embedded elsewhere). You Are Responsible: You are solely responsible for the Content you post and the consequences of posting it. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish the Content you submit and to grant the above license to ClipBust.

3. Prohibited Content and Conduct

You agree not to post any Content or use the Service to engage in any activity that:

• Is illegal, defamatory, fraudulent, or deceptive;
• Is pornographic, obscene, or constitutes "revenge porn;
• Promotes hate speech or incites violence against individuals or groups based on race, ethnic origin, religion, disability, gender, age, veteran status, or sexual orientation/gender identity.;
• Harasses, bullies, or threatens specific individuals;
• Constitutes unauthorized advertising, spam, or pyramid schemes;
• Impersonates any person or entity, including ClipBust employees or representatives;
• Contains private information of any third party without consent (e.g., addresses, phone numbers, financial information);
• Interferes with or disrupts the Service or servers or networks connected to the Service;
• Uses any automated system (e.g., "bots," "spiders") to access the Service or collect user information;
• Circumvents any content-filtering or access control measures we implement.



4. Copyright and DMCA Policy

ClipBust respects the intellectual property rights of others. We operate a policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers of copyright. If you are a copyright owner and believe that Content on ClipBust infringes your copyright, please send a notice of infringement to our designated Copyright Agent at [copyright_agent@clipbust.com] with the information required by the Digital Millennium Copyright Act ("DMCA"). 5. Monetization and Payments

• ClipBust Partner Program: Eligible creators may monetize their Content through our partner program ("ClipBust Partner Program" or "CBPP"). Separate terms and conditions will apply to the CBPP.
• Purchases: The Service may offer paid features, subscriptions (e.g., "ClipBust Premium"), or virtual items. All sales are final, and we do not provide refunds except as required by law or at our sole discretion.



6. Our Intellectual Property

The Service, including its design, text, graphics, logos, icons, and software, is the property of ClipBust or our licensors and is protected by international copyright, trademark, and other laws. Except as explicitly provided in these Terms, ClipBust does not grant any express or implied rights to use the Service.

7. Terminationn

• By You: You may stop using the Service at any time;
• By Us: We may suspend or terminate your account and access to the Service at our sole discretion, without prior notice or liability, for any reason, including if we believe you have violated this Agreement.



8. Disclaimers; Limitation of Liability

  THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. CLIPBUST DISCLAIMS ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

• Content Lability:

  WE ARE NOT RESPONSIBLE FOR THE ACCURACY, USEFULNESS, OR SAFETY OF ANY USER-GENERATED CONTENT. YOU BEAR ALL RISK ASSOCIATED WITH YOUR USE OF THE SERVICE AND ANY CONTENT YOU ACCESS.

• Limitation of Liability:

  TO THE FULLEST EXTENT PERMITTED BY LAW, CLIPBUST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE.

  9. Governing Law and Dispute Resolution
